Terms of Use
Effective as of August 27, 2026
These terms govern your use of the ABC Money Exchange, Inc. website and app. Please read them before creating an account or locking a rate: by doing either, you agree to be bound by them.
1. Acceptance of these terms
By accessing the site, creating an account, or using any of our features, you accept these terms and our Privacy Policy. If you do not agree to them, do not use the service. These terms apply to the digital part of the service; your counter transactions are also governed by applicable regulations and by the documents you sign there.
2. Who may use the service
You must be at least 18 years old and legally able to enter into a contract. The service is intended for customers of our Southern California branches. We reserve the right to refuse or close accounts where necessary to comply with the law or protect the service.
3. Your account
You are responsible for the accuracy of the information you register and for keeping your access credentials confidential. Your account is personal and non-transferable: rate locks it issues may be redeemed only by the account holder, and you will be asked for identification at the counter. Notify us immediately if you detect unauthorized use of your account.
4. What a rate lock is — and is not
A rate lock is a free commitment by ABC to honor a given exchange rate if you come to a branch while it is valid. Its scope matters:
- It is not a currency purchase or sale, nor an order to transact. It is a price commitment: the transaction happens at the counter, not online.
- It does not obligate you to anything. You may choose not to come, though doing so has consequences described in the section on unredeemed locks.
- It is subject to the minimum and maximum amounts in effect when it is issued, which are shown to you before you confirm.
- It is subject to identity verification and to the legal requirements applicable to the transaction. ABC may decline a transaction where the law requires it or where there are reasonable indications of fraud.
- The rate shown on the board when you have not locked anything is informational and changes continuously: only the rate you lock is guaranteed.
5. Validity and cancellation
Every rate lock shows its expiration time when issued and in your profile. Once it expires, the rate is no longer guaranteed. You may cancel an active lock from your profile; doing so forfeits that rate and voids the code. ABC may cancel a lock in the event of a manifest error in the published rate, suspected fraud, or where required by law, and will inform the customer when it does.
6. Unredeemed rate locks
Locking a rate reserves a price commitment, and doing so repeatedly without coming in has a cost to the service. Accordingly:
- Each lock you allow to expire unredeemed counts as a strike on your account.
- Cancelling a lock yourself from the app does NOT count as a strike. We would rather you tell us than have the rate sit reserved for someone who is no longer coming.
- Once you reach the strike limit in effect, your ability to issue new locks is suspended. The suspension affects only that feature: you may continue to transact normally at the counter, and any locks you have already been issued remain valid.
- You can check how many locks you have left at any time from the board while signed in, or by asking at any branch.
- You may request a review of a suspension at any branch.
7. Loyalty program
Your loyalty tier is calculated from your activity and may grant an improvement on the exchange rate up to a set amount. The tiers, amounts and benefits are defined by ABC and may change; changes do not affect rate locks already issued. The program confers no vested rights and has no monetary value outside of it.
8. Referrals and promotional codes
Referral and promotional codes grant a benefit on the exchange rate up to the cap stated on each one. You may use one code per operating day, and only one per transaction. Some codes are not combinable with the loyalty benefit; where that is the case, whichever benefits you more is applied automatically, and you are told when you check the code before confirming. ABC may void codes obtained by fraudulent or automated means, or through duplicate accounts.
9. Auctions
Where ABC enables an auction at a branch, bids are subject to availability and are served in the order customers arrive at the counter. A bid shown on the board does not guarantee its availability at the moment you arrive.
10. Not financial advice
Information on the site, including exchange rates, is provided for informational purposes and does not constitute financial, investment, tax or legal advice. Decisions you make based on it are your own. Exchange rates fluctuate and past performance does not indicate future results.
11. Acceptable use
In using the service, you agree not to:
- Create multiple or false accounts, or impersonate another person.
- Use automated means to access the service, scrape data, or issue rate locks.
- Attempt to circumvent amount limits, frequency limits, or a suspension of the service.
- Interfere with the operation of the site, or attempt to access areas or accounts that are not yours.
- Use the service for any unlawful purpose, including any form of money laundering or illicit financing.
12. Service availability
We aim to keep the service continuously available, but we do not guarantee it. We may suspend it, in whole or in part, for maintenance, for technical reasons, or where we decide not to offer a rate at a given time; when we do, the board says so explicitly. A suspension does not affect the validity of rate locks already issued, which are honored according to their terms.
13. Intellectual property
The site, its content, its design, and the ABC Money Exchange name and logo are the property of ABC or its licensors and are protected by applicable law. You may use them to access the service as a customer; any other use requires our written permission.
14. Disclaimer of warranties
The service is provided "as is" and "as available". To the fullest extent permitted by law, ABC makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the service will be uninterrupted or error-free.
15. Limitation of liability
To the fullest extent permitted by law, ABC will not be liable for indirect, incidental, special, punitive or consequential damages arising out of your use of the service. Nothing here limits our liability for willful misconduct, fraud, or anything the law does not allow to be limited.
16. Governing law
These terms are governed by the laws of the State of California and applicable federal law of the United States, without regard to conflict-of-law rules. Any dispute will be submitted to the courts of competent jurisdiction in San Diego County, California.
17. Changes to these terms
We may modify these terms. When we do, we will update the effective date at the top, and if the change is material we will notify you by a reasonable means. Continuing to use the service after a change takes effect means you accept it. Rate locks already issued are governed by the terms in effect when they were issued.
18. How to contact us
For any question about these terms, email us at info@abcmoneysd.com, call (619) 621-6670, or visit any of our branches in San Ysidro, Otay Mesa or Calexico.
